These Terms of Service ("Terms") are a legal agreement between you ("you", "your") and Kyran Brockett, trading as a sole trader in Australia ("Glow", "we", "us", "our"), the operator of the mobile application Glow: Break Up Recovery (the "App") and any related content, features, and services (together, the "Service").
By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
Please read Sections 3 (Not a Medical, Therapy, or Crisis Service), 4 (AI Features and Their Limits), 15 (Disclaimers), 16 (Australian Consumer Law), and 17 (Limitation of Liability) carefully. They limit our obligations and your rights, and they explain important safety information.
1. Who We Are and How to Contact Us
The App is operated by Kyran Brockett, a sole trader based in Australia. You can contact us at glowbreakupapp@gmail.com for any questions about these Terms or the Service.
2. Eligibility
The App is intended for personal, non-commercial use by individuals going through, or recovering from, a relationship breakup.
You may use the App only if you are 16 years of age or older. If you are between 16 and 18 (or the age of legal majority where you live), you confirm that you have the involvement or consent of a parent or guardian to the extent required by the laws of your country, and that you have the capacity to enter into these Terms.
The App is not intended for children under 16, and we do not knowingly allow anyone under 16 to create an account or submit personal information. If we learn that we have collected information from someone under 16, we will delete it.
By using the App, you represent that you meet these requirements and that all information you provide is accurate.
3. Not a Medical, Therapy, or Crisis Service
This is the most important part of these Terms. Please read it fully.
Glow is a self-help and wellbeing app designed to support people emotionally after a breakup. It is intended for general informational, educational, motivational, and self-reflection purposes only.
Glow is not a healthcare service. In particular, the App and everything in it (including AI-generated content, affirmations, prompts, exercises, journaling features, and community discussions):
- is not medical, psychological, psychiatric, therapeutic, or counselling advice;
- is not a substitute for professional diagnosis, treatment, or care from a qualified doctor, psychologist, therapist, counsellor, or other licensed health professional;
- does not create any therapist–client, doctor–patient, or other professional or fiduciary relationship between you and us; and
- should not be relied upon to make decisions about your health, safety, relationships, finances, or any other significant matter.
We are not health professionals, and we do not provide any form of clinical care, crisis intervention, or emergency service. You should always seek the advice of a qualified professional with any questions you have about your mental or physical health. Never disregard professional advice, or delay seeking it, because of something you read, saw, or generated in the App.
Your use of the App, and your reliance on any of its content, is entirely at your own risk (see Sections 15 and 17).
4. Emergencies and Mental Health Crises
The App cannot help you in an emergency and is not monitored for cries for help.
If you are in crisis, thinking about harming yourself or others, or are otherwise in immediate danger, stop using the App and get help now:
- Call your local emergency number immediately — in Australia, dial 000; in the United States or Canada, dial 911; in the United Kingdom or Europe, dial 999 or 112.
- Contact a crisis or suicide-prevention line in your country. In Australia, you can call Lifeline on 13 11 14 or the Suicide Call Back Service on 1300 659 467. In the United States, you can call or text 988. In the United Kingdom, you can call Samaritans on 116 123.
- Reach out to a trusted person, or go to your nearest hospital emergency department.
We do not, and cannot, monitor your activity in the App in real time, respond to emergencies, or contact emergency services on your behalf.
5. Your Account
To use certain features, you must create an account. You can sign in using Sign in with Apple or with your email address (via a one-time sign-in code). You are responsible for:
- keeping your account and sign-in method secure;
- all activity that occurs under your account; and
- notifying us promptly at glowbreakupapp@gmail.com if you suspect unauthorised use of your account.
You must provide accurate information and keep it up to date. You may not share your account, impersonate anyone, or create an account on behalf of someone else without authority.
6. Subscriptions, Billing, and Refunds
6.1 Paid access
The App is a paid product. Access to premium features is offered through paid plans, which may include:
- a recurring weekly subscription; and
- a three-month access plan ("Transformation" plan).
The current plans, prices, billing frequency, and any free trial or introductory offer are shown in the App and on the App Store at the point of purchase. Prices may vary by country and may change over time.
6.2 Billing through the App Store
All purchases are processed by Apple through your App Store account, under Apple's terms and payment methods — not by us directly. We do not receive or store your payment card details.
Where a plan is an auto-renewing subscription, it will automatically renew at the end of each billing period, and your Apple account will be charged for the renewal, unless you cancel at least 24 hours before the end of the current period. You can manage or cancel your subscription at any time in your device's Settings → your name → Subscriptions (or App Store subscription settings). Deleting the App does not cancel a subscription.
6.3 Refunds
Because purchases are handled by Apple, refund requests are managed by Apple in accordance with App Store policies. We generally do not have the ability to issue refunds directly. You can request a refund through Apple (for example, at reportaproblem.apple.com).
Nothing in this Section limits any refund or remedy you are entitled to that cannot be excluded under the Australian Consumer Law or other applicable consumer protection laws (see Section 16).
7. Licence to Use the App
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to download and use one copy of the App on Apple devices that you own or control, for your own personal, non-commercial use.
You must not, and must not allow anyone else to:
- copy, modify, adapt, translate, or create derivative works of the App;
- reverse engineer, decompile, or disassemble the App, or attempt to extract its source code, except to the extent this restriction is prohibited by law;
- rent, lease, lend, sell, redistribute, or sublicense the App;
- remove or alter any proprietary notices;
- use the App in any unlawful way, or in a way that could damage, disable, or impair the Service; or
- access the Service using automated means, or attempt to gain unauthorised access to any part of the Service or its related systems.
We reserve all rights not expressly granted to you.
8. Apple App Store Terms
You acknowledge that these Terms are between you and us only, and not with Apple, and that Apple is not responsible for the App or its content. This Section applies in addition to Apple's Licensed Application End User Licence Agreement (the "Apple EULA"), which also governs your use of the App. If these Terms conflict with the Apple EULA in relation to your use of the App, the Apple EULA prevails, but only to the extent of the conflict.
You agree that:
- Apple has no obligation to provide maintenance or support for the App;
- to the extent permitted by law, Apple has no warranty obligation for the App, and any claims relating to the App are our responsibility, not Apple's, as set out in these Terms;
- Apple is not responsible for addressing any claims by you or a third party relating to the App, including product liability, legal or regulatory non-compliance, or consumer protection claims;
- if a third party claims the App infringes their intellectual property rights, we (not Apple) are responsible for the investigation, defence, settlement, and discharge of that claim to the extent required by these Terms; and
- you comply with all applicable third-party terms and applicable export and sanctions laws when using the App.
Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
9. Community Features: Group Chat and Forum
The App includes social features, including a group chat and a community forum, where you can communicate with other users ("Community Features").
Content in the Community Features is not private. Messages you post can be seen, stored, copied, and shared by other users and by us. Do not post anything you would not want others to see or keep. Do not share sensitive personal information (yours or anyone else's) in these spaces.
Glow has zero tolerance for objectionable content or abusive users. We use automated text filtering for Feed posts and replies and a narrower send-time filter for Breakup Buddies messages. These filters allow ordinary discussion of recovery topics but cannot catch every violation. Users can report content or members; we review reports daily and act on violations by removing or restricting content and suspending or terminating abusive accounts as appropriate. Community discussions are not a monitored crisis service, and other users are not health professionals.
You can report a Feed post or reply from its options menu and block its author. A Feed block hides that person's posts and replies from you immediately on that device and submits the selected content for moderation review. Feed blocks do not sync between devices or stop another user from viewing your public posts. In Breakup Buddies, you can report a message or member and select Block in circles to hide the member's messages. Once a Circle block syncs, supported app versions mutually hide your messages across devices and future circles; both people may remain in the same circle. Blocking also submits a member report, and a message report when selected from an available message. Other members may still see the messages. See the in-app Terms for the full reporting, filtering, and blocking details.
10. Acceptable Use and Community Rules
When using any part of the Service, and especially the Community Features, you must not:
- post content that is unlawful, harassing, bullying, threatening, hateful, defamatory, obscene, sexually explicit, or otherwise objectionable;
- encourage, glorify, or provide instructions for self-harm, suicide, eating disorders, violence, or illegal activity;
- harass, stalk, dox, threaten, or attempt to identify, locate, or contact another user without their consent;
- post another person's private or identifying information, or content that violates another person's privacy or rights;
- impersonate any person or misrepresent your affiliation with anyone;
- post spam, advertising, solicitations, scams, or promotional or commercial content;
- upload viruses or malicious code, or attempt to disrupt or overload the Service;
- infringe anyone's intellectual property, privacy, or other rights; or
- use the Service to give medical, psychological, legal, financial, or other professional advice, or hold yourself out as qualified to do so.
We may remove content, restrict features, and suspend or terminate accounts that we reasonably believe breach these rules, at our discretion, with or without notice (see Section 19).
11. Your Content
11.1 Content stored on our systems
"Your Content" means content you submit through features that store data on our systems, such as messages you post in the group chat or forum, and the profile and onboarding information you provide.
You retain ownership of Your Content. By submitting it, you grant us a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, reproduce, display, adapt (for formatting and technical purposes), and distribute Your Content solely to operate, provide, secure, and improve the Service — for example, to show your forum posts to other users. This licence ends when you delete Your Content or your account, except that (a) we may retain copies as required by law or for backup and security for a reasonable period, and (b) content you shared with others may persist in their copies or where they have re-shared it.
You are solely responsible for Your Content and represent that you have the rights to submit it and that it does not breach these Terms or any law.
11.2 Content stored only on your device
Certain features — including your journals, notes, voice recordings, and video recordings — are stored locally on your device and are not uploaded to or stored on our servers. We do not have access to this content, and we cannot recover, restore, back up, or retrieve it for you.
You are responsible for backing up this content yourself. If you delete the App, change or reset your device, or lose access to your device, this content may be permanently lost. We are not liable for any such loss.
12. Feedback
If you send us feedback, suggestions, or ideas about the Service, you agree that we may use them without restriction or obligation to you, and you grant us a perpetual, irrevocable, worldwide, royalty-free licence to use them for any purpose.
13. Third-Party Services
The Service relies on third-party providers, including Apple (distribution and payments), Supabase (authentication, database, and hosting), and one or more third-party artificial-intelligence providers that power the App's AI features (currently including OpenAI; our providers may change over time). Your use of the Service may be subject to those third parties' own terms and privacy practices. We are not responsible for third-party services, and we do not control and are not liable for their acts or omissions. Our handling of your data is described in our Privacy Policy.
Lila currently uses OpenAI's API for conversations, activity support, summaries and memories. Before Glow sends personal information for those purposes, the App shows a separate AI data-sharing disclosure and asks you to choose Allow sharing with OpenAI. Accepting these Terms or the Privacy Policy does not grant that permission. You may decline or withdraw it in Profile → Lila → AI Data Sharing while retaining access to other features and saved local chats. Withdrawal cannot recall information already sent, and an offline withdrawal needs a connection to synchronize across your account. Section 6 of our Privacy Policy explains the information shared, purposes, protections and retention.
14. Intellectual Property
The App and the Service, including all software, text, graphics, designs, logos, layouts, affirmations, prompts, exercises, and other content we provide (excluding Your Content and user content), are owned by us or our licensors and are protected by intellectual property laws. The name "Glow: Break Up Recovery" and our logos are our property. Nothing in these Terms transfers any of these rights to you, except for the limited licence in Section 7.
15. Disclaimers
Please read this Section together with Section 16 (Australian Consumer Law). Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition, implied or imposed by law that cannot lawfully be excluded or limited.
Subject to that, and to the maximum extent permitted by law:
- the Service is provided "as is" and "as available", with all faults, and without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement;
- we do not warrant that the Service will be uninterrupted, timely, secure, error-free, or free of viruses or harmful components, or that any content (including AI-generated content) is accurate, complete, reliable, current, or suitable for you;
- we make no warranty regarding any outcome, result, benefit, recovery, or improvement in your wellbeing or circumstances from using the Service; and
- any content, advice, or information you obtain through the Service is used at your own risk, and you are solely responsible for your decisions and actions.
16. Your Rights Under the Australian Consumer Law
If you are a "consumer" under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)), our goods and services come with guarantees that cannot be excluded. Nothing in these Terms operates to exclude, restrict, or modify the application of those consumer guarantees, or the exercise of any right or remedy, or the imposition of any liability, where to do so would be unlawful.
Where our services come with a guarantee that cannot be excluded under the Australian Consumer Law, and where it is fair and reasonable to do so, our liability for failing to comply with that guarantee is limited, at our option, to supplying the services again, or paying the cost of having the services supplied again. Similar rights may apply to consumers under the laws of other countries; nothing in these Terms limits any non-excludable rights you have under the laws that apply to you.
17. Limitation of Liability
Subject to Section 16 and to any liability that cannot be excluded or limited by law, and to the maximum extent permitted by law:
- we (and our related parties, licensors, and suppliers) will not be liable to you for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or anticipated savings, arising out of or in connection with the Service or these Terms, however caused, even if we have been advised of the possibility of such damages;
- we will not be liable for any harm, loss, or damage arising from: (a) your reliance on any content, including AI-generated content and other users' content; (b) any decision or action you take, or fail to take, based on the Service; (c) any deterioration in, or failure to improve, your mental, emotional, or physical health; (d) the acts, omissions, or content of other users; (e) loss of, or inability to access, content stored locally on your device; or (f) unauthorised access to or use of your account or data that is not caused by our failure to take reasonable care; and
- our total aggregate liability for all claims arising out of or in connection with the Service or these Terms, whether in contract, tort (including negligence), statute, or otherwise, is limited to the total amount you paid us (or paid through the App Store for the App) in the 12 months before the event giving rise to the claim.
These limitations apply to the fullest extent permitted by law and reflect a reasonable allocation of risk. Some jurisdictions do not allow certain exclusions or limitations, so some of the above may not apply to you; in that case, our liability is limited to the smallest extent permitted by law.
18. Indemnity
To the maximum extent permitted by law, you agree to indemnify and hold harmless Glow (Kyran Brockett) and our related parties from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or connected with: (a) your breach of these Terms; (b) Your Content or your use of the Community Features; (c) your misuse of the Service; or (d) your violation of any law or the rights of any third party. This Section does not apply to the extent a claim arises from our own breach of these Terms or our negligence, or to the extent such an indemnity is not permitted by law.
19. Suspension and Termination
You may stop using the Service at any time and may delete your account through the App or by contacting us.
We may suspend, restrict, or terminate your access to all or part of the Service at any time, with or without notice, if we reasonably believe that: you have breached these Terms; your use poses a risk to us, other users, or third parties; or we are required to do so by law, or we discontinue the Service.
On termination, your licence to use the App ends and you must stop using it. Sections that by their nature should survive termination (including Sections 11, 12, 14–18, and 20–22) will survive. Termination does not automatically cancel any App Store subscription — you must cancel that through Apple (see Section 6.2).
20. Changes to the Service and to These Terms
We are continually developing the Service and may add, change, suspend, or remove features at any time. We may also update these Terms from time to time — for example, to reflect changes to the App, our providers, or the law. If we make material changes, we will take reasonable steps to notify you, such as through the App or by updating the "Last updated" date above. Changes take effect when posted. Your continued use of the Service after changes take effect means you accept the updated Terms. If you do not agree, you must stop using the Service.
21. Governing Law and Disputes
These Terms are governed by the laws of Victoria, Australia, without regard to conflict-of-laws principles. You and we submit to the non-exclusive jurisdiction of the courts of that State or Territory and the courts competent to hear appeals from them.
If you are a consumer resident in a country whose laws grant you mandatory protections (for example, in the European Union or United Kingdom), nothing in this Section deprives you of the protection of the mandatory consumer-protection provisions of the country where you live, or of your right to bring proceedings there.
Before starting formal proceedings, we encourage you to contact us at glowbreakupapp@gmail.com so we can try to resolve the issue informally.
22. General
- Entire agreement. These Terms, together with our Privacy Policy and the Apple EULA, are the entire agreement between you and us about the Service and replace any prior agreements.
- Severability. If any provision is found to be unenforceable, the rest of the Terms remain in effect, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable.
- No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
- Assignment. You may not assign or transfer these Terms without our consent. We may assign or transfer these Terms to a successor or in connection with a merger, acquisition, or sale of assets.
- Force majeure. We are not liable for any failure or delay caused by events beyond our reasonable control.
- Notices. We may provide notices to you through the App or the email associated with your account. You can send notices to us at glowbreakupapp@gmail.com.
